Welcome to www.danielamilitaru.com (the “Site”).
The Site is operated by Daniela Militaru, a self-employed artist based in England (“we”, “us”, “our”).

These Terms govern your use of the Site and all purchases of products including original artworks, A4 watercolours, furniture, and apparel. By accessing or using the Site, or placing an order, you agree to be bound by these Terms.

2. Products

a) Original Artwork & Watercolours

  1. All artworks and watercolours are hand-painted originals created by Daniela Militaru. Each piece is one-of-a-kind and sold unframed unless stated otherwise.

  2. Once sold, an artwork will not be available again and may remain displayed online for portfolio purposes.

  3. We make every effort to display colours accurately, but slight variations may occur due to screen differences.

  4. Packaging may differ from images shown.

b) Furniture

  1. Furniture items are individually crafted or hand-finished. Each piece is described accurately on the Site.

  2. Minor variations in colour, finish, or texture may occur due to the handmade nature of the items.

c) Apparel (Print-on-Demand)

  1. Apparel is fulfilled by a third-party partner (e.g. Printful).

  2. Each item is made to order after purchase; production and delivery times may vary.

  3. Delivery estimates and fulfilment details are shown on each product page.

3. Personal Data

We handle your personal information in accordance with our Privacy Policy. Please read it carefully before placing an order.

4. Who Can Buy

  1. Consumers must be 18 years or older to purchase.

  2. Business buyers confirm they have authority to represent their organisation and that these Terms constitute the entire agreement.

5. Contract Formation

  1. Orders are placed via the Site and confirmed by email.

  2. A contract is formed when we accept your order and process payment.

  3. Because most artworks and furniture are one-of-a-kind, if two people buy the same item simultaneously, the earliest completed order will be honoured and the other refunded.

6. Price & Payment

  1. All prices are in GBP (£) and include VAT where applicable.

  2. Delivery charges are shown at checkout.

  3. We accept payment via credit/debit card, PayPal, Apple Pay, or Google Pay (via Shopify Payments).

  4. Prices may change at any time but will not affect confirmed orders.

  5. We are not responsible for pricing errors that are obvious and could reasonably have been recognised as such.

7. Delivery

  1. Delivery will be made to the address provided at checkout.

  2. We aim to dispatch within 30 days of order confirmation unless otherwise stated.

  3. Christmas / Holiday pause: Orders placed after 17 December will be accepted but not dispatched until 10 January. This is clearly stated on the Site banner and product pages.

  4. Risk transfers to you on delivery; ownership transfers once full payment is received.

8. Right to Cancel (Consumers)

  1. Under the Consumer Contracts Regulations 2013, UK and EU consumers have 14 days from the day they receive their item to change their mind.

  2. The right to cancel does not apply to:

    • Custom-made, commissioned, or personalised artwork/furniture.

    • Apparel made to order by a print-on-demand provider.

  3. To cancel, email daniela_militaru@outlook.com using the cancellation form below.

  4. You must return the item within 14 days of cancellation, in its original packaging and condition.

  5. You are responsible for return postage costs unless the item was faulty or misdescribed.

  6. Refunds are made to the original payment method within 14 days of receiving the return (or proof of posting).

  7. If an artwork or furniture item has been handled beyond what is necessary to inspect it, we may deduct an appropriate amount from the refund.

9. Faulty or Damaged Goods

If an item arrives damaged or not as described, contact daniela_militaru@outlook.com within 7 days with photographs.
Because most artworks are unique, replacement may not be possible; in such cases, we will issue a full refund.

10. Our Right to Cancel

We may cancel an order and issue a refund if:

  • the product is unavailable or mispriced;

  • payment is not authorised;

  • fraud is suspected; or

  • incomplete or incorrect delivery information is provided.

11. Events Outside Our Control

We are not liable for delays or failure to perform caused by circumstances beyond our reasonable control (e.g. postal strikes, natural disasters, illness, war). If delays occur, we will inform you and offer the choice to wait or cancel for a refund.

12. Liability (Consumers)

We are responsible for foreseeable losses caused by our failure to comply with these Terms. We are not liable for business losses or losses we could not reasonably foresee. Nothing in these Terms limits liability where it would be unlawful to do so.

13. Intellectual Property

All artwork, images, text, and content on this Site are owned by Daniela Militaru and protected by copyright. You may not copy, reproduce, or use them for commercial purposes without written permission.

14. Changes to These Terms

We may update these Terms periodically. The version posted on the Site at the time you place your order is the version that applies.

15. Governing Law

These Terms are governed by English law.
You may bring legal proceedings in the English courts, or in Scotland/Northern Ireland if you reside there.

Section B – Apparel (Print-on-Demand)

This section applies only to Apparel sold through the Site.

  1. Apparel items are printed and shipped by a third-party provider (e.g. Printful).

  2. Orders are made to order; typical fulfilment time is 3–7 business days plus delivery.

  3. Delivery estimates vary by region and are displayed on product pages.

  4. Customs fees or import duties may apply outside the UK and are the buyer’s responsibility.

  5. Because each item is custom printed, returns and exchanges are not offered unless the item arrives damaged or incorrect.

  6. If you receive a wrong or damaged item, contact daniela_militaru@outlook.com within 7 days with photos and your order number.

  7. Refunds or replacements will be arranged as appropriate.

  8. This section is governed by English law and interpreted in the English language.
