1. Who we are

danielamilitaru.com is run by Elena-Daniela Militaru, a sole trader based in England, trading as Daniela Militaru (“we”, “us”).

2. These terms

These terms apply when you buy a work from this website, or by invoice from the studio. Together with our Shipping Policy and our Refund and Returns Policy, they form the contract between us. Please read all three before ordering. If you are buying as a consumer, you have legal rights that nothing in these terms affects.

You must be 18 or over to buy. If you buy on behalf of a business, you confirm you have authority to do so.

3. The works

Every work sold here is an original, painted by hand by Daniela Militaru and signed. Each is one of one. Works are sold unframed unless the product page says otherwise. Works come with a numbered certificate of authenticity.

We photograph each work carefully, but colour varies between screens, and a photograph cannot fully capture a painted surface. Small differences from the images are not a fault.

Sold works may remain on the website as part of the artist’s portfolio.

4. Your order and the contract

When you place an order, we email you to confirm it. The contract between us starts when that confirmation is sent.

Each work exists once. If two orders for the same work arrive at the same moment, the first completed order is accepted, and the other is cancelled and refunded in full.

5. Price and payment

Prices are in pounds sterling. We are not VAT registered, so no VAT is charged. Any delivery charge is shown at checkout before you pay.

Payment is taken in full when you order, by the methods shown at checkout. Paintings delivered outside the UK are paid for by invoice, as our Shipping Policy explains.

If a price is clearly wrong because of an obvious error, we will contact you before dispatch. You can then pay the correct price or cancel for a full refund.

6. Delivery

Delivery options, times and costs are set out in our Shipping Policy. Unless we agree a different date with you, we deliver within 30 days of the contract starting.

A work is at our risk until it is delivered to you, or to someone you nominate to receive it. It becomes yours once we have received full payment.

7. Changing your mind

If you are a consumer, you can cancel at any time from placing your order until 14 days after you receive the work. Our Refund and Returns Policy explains how to cancel, how to return the work and how refunds are made, and includes a cancellation form.

8. If something is wrong

If a work arrives damaged or is not as described, please tell us as soon as you can. Our Refund and Returns Policy explains what to do. Because each work is an original, we usually cannot replace it, so we refund you in full, including delivery. Your rights under the Consumer Rights Act 2015 apply in full.

9. Our right to cancel

We may cancel an order before dispatch, with a full refund, if the work is no longer available, if payment is not authorised, if we reasonably suspect fraud, or if we cannot deliver to the address given. We will tell you by email.

10. Events outside our control

We are not responsible for delays caused by events outside our reasonable control, such as postal disruption, severe weather or serious illness. If this happens, we will tell you, and you can choose to wait or to cancel for a full refund.

11. Our responsibility to you

We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable. If you are a consumer, we are not responsible for business losses. Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else where limiting liability would be unlawful.

12. Copyright

Buying a work transfers ownership of the physical work, not its copyright. Copyright in every work, and in the images and text on this website, belongs to Daniela Militaru. You may photograph a work you own and share those photographs for non-commercial purposes, credited to the artist. Any other reproduction, including prints, products or commercial use, needs written permission.

13. Your personal data

How we use your personal data is set out in our Privacy Policy and Cookie Policy.

14. Complaints and law

If you have a complaint, email studio@danielamilitaru.com. We aim to reply within 5 working days.

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts. If you live outside the UK, you keep any protection the law of your country gives you.

15. Changes to these terms

We may update these terms. The version on the website when you place your order is the one that applies to it.
